Under the Digital Personal Data Protection Act, 2023, Menerix acts as the Data Fiduciary for the data you provide. You, the User, are the Data Principal. Account Registration Data: When you create an account, we collect your name, email address, mobile number, company name, and password.

Know Your Customer (KYC) and Verification Data: To verify your business identity, we collect information such as:

  • For Businesses: GSTIN, Certificate of Incorporation, Udyam Aadhar, PAN card, and business address proof.
  • For Individuals (as representatives): Name, government-issued ID (like PAN or Aadhaar), and contact details of authorized representatives.

Profile Information: As a Seller, you may provide your company profile, factory/plant location, production capabilities, product catalogues, images, and promotional videos.

Communications: We collect information when you communicate with us, such as through our support channels, or when you communicate with other users on the Platform.

2.2. Information We Collect Automatically:

Usage Data: We automatically log information about your interaction with our Platform, including your IP address, browser type, operating system, pages viewed, links clicked, and the dates and times of your visits.

Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to operate and personalize our services, analyze performance, and for marketing purposes. Please see our "Cookies" section below for more details.

3. How We Use Your Information

We use the information we collect for the following legitimate business purposes:

  • To Provide and Manage Our Services: To create and manage your account, facilitate connections between Buyers and Sellers, and enable transactions.
  • For Verification and Security: To conduct our mandatory 3-tier verification process for Sellers and KYC for Buyers, to prevent fraud, and to maintain the integrity and security of our Platform.
  • To Communicate with You: To send you service-related notifications, updates, security alerts, and respond to your inquiries.
  • To Improve Our Platform: To analyze usage trends, conduct research and development, and enhance the user experience, features, and functionality of Menerix.
  • For Marketing and Promotions: To inform you about services, features, or promotions that may be of interest to you, in accordance with your communication preferences. You may opt-out of marketing communications at any time.
  • To Comply with Legal Obligations: To meet our legal and regulatory requirements, including tax laws, and to respond to lawful requests from government authorities.

4. Legal Basis for Processing Your Data

Our legal basis for collecting and using your information depends on the specific context:

  • Consent: We process your data based on your explicit consent when you register and agree to our Terms and this Privacy Policy.
  • Performance of a Contract: We process your data to fulfill our contractual obligations to you under our Terms and Conditions.
  • Legitimate Interests: We process data for our legitimate interests, such as improving our Platform and preventing fraud, provided it does not override your rights and interests.
  • Legal Obligation: We process data where we have a legal duty to do so (e.g., for KYC and anti-fraud verification).

5. How We Share Your Information

  • With Other Users: We share information between Buyers and Sellers to facilitate discovery and transactions. For example, a Seller's company profile is visible to verified Buyers, and a Buyer's inquiry is shared with the relevant Seller.
  • With Service Providers: We engage third-party companies to perform services on our behalf, such as cloud hosting (e.g., AWS, Google Cloud), payment processing, data analytics, and customer support. These providers are contractually obligated to protect your data and may only use it for the specific services they provide to us.
  • For Legal Reasons: We may disclose your information if required by law, court order, or governmental authority, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Menerix, our users, or the public.
  • In Case of Business Transfer: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

6. Data Security

We implement commercially reasonable technical, administrative, and physical security measures to protect your information from unauthorized access, alteration, disclosure, or destruction. We may also retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Once the purpose is fulfilled, your data will be securely erased.

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. We will notify you of any material changes by posting the new policy on this page and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Privacy Policy.
